請學生使用正版教科書(含二手書),勿擅自掃描、影印、下載或上傳書籍、教材,以免侵害他人著作權.
Faculty and staff members, please remind students to use legal versions of textbooks (including second-hand books); do not infringe upon intellectual property rights by scanning without permission, making a pirate copy, downloading or uploading any books or materials illegally.
一、依著作權法規定,著作人就其著作專有重製及公開傳輸之權利,掃描、影印、下載或上傳他人著作,涉及重製、公開傳輸等著作利用行為,除有符合著作權法第44條至第65條規定之合理使用情形外,應事先取得著作財產權人之同意或授權,始符合著作權法的規定。
According to Copyright Act, authors have the right to reproduce and publicly transmit their work. Since “scanning, copying, downloading, or uploading” are means of reproduction, it’s necessary to follow the Copyright Act when copying other people’s work. A copy must meet the fair use definition in Copyright Act article 44 and article 65 and receive the intellectual property right holder’s permission or authorization.
二、大專校院學生掃描、影印國內、外之書籍,如係整本或為其大部分、化整為零之掃描、影印,或任意下載、上傳他人論文等,此等利用行為均已超出合理使用範圍,將構成著作權之侵害行為,如遭著作財產權人依法追訴,恐須負擔刑事及民事之法律責任,提醒學生使用正版教科書(含二手書),勿非法影印他人著作,以免觸法。
When students scan, copy, download or upload Chinese or foreign language textbooks, whether the whole content at once, most of the content or all the material at separate times, none of these meet the definition of fair use. This behavior is considered a violation of copyright, for which violators must bear responsibility under criminal law and civil law once the intellectual property right holder resorts to legal measures. Faculty and staff members, please remind students use legal versions of textbooks (including second-hand books). Do not break the law by making a pirate copy of any books illegally!
